Court Says Administration Violated Constitution in Funding Obamacare Subsidies

Judge Rosemary Collyer of the U.S. District Court for the District of Columbia stated the Obama administration violated the Constitution in funding Obamacare subsidies for which Congress didn't appropriate the funds and that's a violation of the Constitution. Collyer wrote in her opinion that "Congress passes all federal laws in this country in the case of U.S. House of Representatives vs. Burwell. "The Court will enter judgment in the favor of the House of Representatives and enjoin the use of unappropriated monies to fund reimbursements due to insurers under section 1402," the judge stated. The judge also made a distinction between section 1401 and 1402 as well. Section 1401 was incorporated into the internal revenue code but section 1402 wasn't.
